Please read these General Terms and Conditions (the “Terms and Conditions”) carefully before accessing and using the website noctra.gg.

1. Introduction

1.1. ARTEMIX LIMITED, a company organised under the laws of Ireland with registration number 758562, and having its registered office at 36-42 Donnybrook Road, Donnybrook House, D04 E6X0 Dublin, Ireland, operates the website noctra.gg under the NOCTRA brand (“NOCTRA”, “we”, “us”, “our”).

1.2. NOCTRA has created an online reseller platform through which consumers can access and purchase digital video game skins, in-game cosmetic items and similar digital items (the “Digital Items”). The platform only serves the purpose of allowing NOCTRA to resell Digital Items sourced from third-party suppliers, distributors, inventory providers, marketplaces or supported platforms to consumers.

1.3. When you purchase a Digital Item through the reseller platform, you enter into a purchase agreement with NOCTRA for the selected Digital Item.

1.4. NOCTRA does not operate a peer-to-peer marketplace and does not allow users to list, sell, trade, exchange, auction or transfer Digital Items to other users through the platform.

1.5. NOCTRA does not provide customer wallets, deposits, withdrawals, stored-value accounts, cash balances, money transmission, exchange services, investment services, loot boxes, mystery boxes, randomised products or chance-based products.

1.6. These Terms and Conditions together with NOCTRA’s Privacy Policy form a legal agreement between you and NOCTRA governing your access to and use of the reseller platform.

1.7. To access the reseller platform, you need an internet connection and a computer, smartphone, tablet or other compatible device with a web browser.

1.8. You may only use the reseller platform for your personal, lawful and non-commercial use.

1.9. The language of the agreement is English and all communications will be conducted in English unless otherwise stated.

2. Disclaimers and Risks Associated with Digital Items

2.1. Access to and use of the reseller platform is at your own risk.

2.2. Digital Items are digital in-game or platform-based items that are made available, held, transferred, used or displayed through third-party video games, video game accounts, inventory systems, trading systems or supported platforms.

2.3. NOCTRA does not own or control Steam, Valve, game publishers, game developers, game servers, supported platforms, supplier systems, trading systems, inventory systems or third-party marketplaces.

2.4. By using the reseller platform, you accept and acknowledge that:

  • the value of Digital Items is subjective;
  • Digital Items must not be considered investments, financial instruments, securities, stored value or cash-equivalent products;
  • prices of Digital Items may fluctuate and may change after purchase;
  • availability of a Digital Item may change before delivery if the item is purchased, reserved, removed or otherwise becomes unavailable through a supplier, marketplace or supported platform;
  • Digital Items may be subject to restrictions imposed by Steam, game publishers, game developers, supported platforms or suppliers;
  • NOCTRA cannot guarantee that any supported platform, game publisher, game developer or supplier will continue to support, display, recognise, transfer or allow use of a Digital Item after delivery;
  • technical issues, platform outages, API downtime, trading restrictions, inventory restrictions, account restrictions, trade holds, private inventory settings or supplier failures may delay or prevent delivery;
  • you are responsible for ensuring that the Steam Trade URL, platform account, inventory account or other delivery details provided by you are correct, active and able to receive the Digital Item;
  • there are risks associated with using internet-based digital products, including account compromise, phishing, malware, device failure, unauthorised access, platform restrictions and third-party technical failures;
  • NOCTRA is not affiliated with, endorsed by, sponsored by or officially connected with Valve, Steam, any game publisher, game developer, supported platform or trademark owner unless expressly stated on the reseller platform.

2.5. Digital Items are sold for personal entertainment and use within the relevant game or supported platform. NOCTRA does not guarantee resale value, market value, future availability, future transferability or continued usability of any Digital Item.

3. Using the NOCTRA Reseller Platform

3.1. Requirements for using the reseller platform

To use the reseller platform and purchase Digital Items, you must:

  • be a private individual acting as a consumer;
  • use the reseller platform only for personal and lawful purposes;
  • provide accurate account, contact, payment and delivery information;
  • provide a valid Steam Trade URL, platform account identifier or other delivery details where required;
  • use only a payment method that you are authorised to use;
  • accept these Terms and Conditions;
  • comply with the rules and terms of any supported platform relevant to the Digital Item.

NOCTRA may decline, suspend or cancel an order where necessary for fraud prevention, payment verification, supplier requirements, supported platform requirements, sanctions controls, legal compliance, technical reasons or internal risk controls.

3.2. Accounts and access

NOCTRA may allow users to access the reseller platform through a customer account, email-based login, guest checkout or other account functionality made available from time to time.

You are responsible for keeping your login credentials, email account, Steam account, supported platform account and related security details safe and confidential.

If you become aware of unauthorised access to your account, email, Steam account, platform account or delivery details, you should contact NOCTRA as soon as possible.

NOCTRA is not responsible for loss caused by your failure to secure your email account, Steam account, platform account, device, password, trade URL or other delivery credentials.

3.3. Purchasing Digital Items

NOCTRA provides users with a reseller platform offering the possibility to purchase Digital Items sourced from third-party suppliers, distributors, inventory providers, marketplaces or supported platforms.

When you decide to purchase a Digital Item through the reseller platform, you enter into a purchase agreement with NOCTRA for the Digital Item selected by you.

The essential characteristics of each Digital Item are disclosed on the product detail page or checkout page. These may include, where available, the item name, game, supported platform, image, rarity, exterior, wear, float value, pattern, price, availability and other relevant item information.

Information relating to Digital Items may be provided by suppliers, supported platforms, public item databases, marketplaces or other third-party data sources. NOCTRA takes reasonable steps to display accurate information but does not guarantee that third-party item data will always be complete, error-free or continuously available.

You are responsible for reviewing the Digital Item, price, delivery details and checkout information before completing the purchase.

Unless otherwise stated on the product page, the purchase of a Digital Item does not include any assignment of copyright, trademark, artwork, game asset, publisher IP or other intellectual property rights.

Delivery of Digital Items is arranged through supplier/API fulfilment, Steam Trade URL delivery, supported platform inventory transfer, account-based delivery, on-screen confirmation, customer account area, email notification or another delivery method supported by NOCTRA or its fulfilment providers.

Delivery times may vary depending on supplier availability, payment verification, fraud screening, supported platform systems, API processing, technical limitations or account restrictions.

3.4. Refunds and chargebacks

A “Refund” means the restitution of an amount paid by the user and the cancellation of the relevant order in part or in full.

All sales are final once supply of the Digital Item has begun or the Digital Item has been delivered, except where a refund or remedy is required by law or expressly provided in these Terms and Conditions.

You may only be eligible for a refund in the following cases:

  • the Digital Item purchased by you becomes unavailable before delivery because it was simultaneously purchased, reserved, removed or otherwise became unavailable through a supplier, marketplace or supported platform;
  • delivery fails due to a technical error attributable to NOCTRA, its supplier or fulfilment provider;
  • the Digital Item delivered is materially different from the Digital Item purchased, based on the item details displayed at checkout;
  • you were charged but no order was accepted or fulfilled;
  • a duplicate charge occurred;
  • a refund is required under applicable law.

Refunds are not available where:

  • the Digital Item has been successfully delivered to the delivery details provided by you;
  • you change your mind after purchase or delivery;
  • the market price, rarity, perceived value, availability or resale value changes after purchase;
  • you provided incorrect, incomplete, expired, restricted or inaccessible delivery details;
  • you lose access to your email, Steam account, game account, platform account or inventory after delivery;
  • a supported platform, game publisher, game developer, supplier or third party later restricts, removes, disables, reverses, changes or limits the Digital Item or your account;
  • you breach these Terms and Conditions or the rules of a supported platform;
  • the issue results from your device, account settings, trade restrictions, private inventory settings, security settings or failure to follow delivery instructions.

Upon confirmation by NOCTRA that a refund has been granted, the refund will be processed to the original payment method normally within 5 to 10 business days, although the time for funds to appear may depend on your card issuer, bank or payment provider.

A “Chargeback” means the return of funds to a customer’s credit card or debit card account after the customer disputes a card payment with their card issuer or bank.

The initiation and handling of chargebacks is subject to the rules of the relevant card issuer, bank, payment provider and card network.

NOCTRA will cooperate with payment processors, acquiring banks, card issuers and card networks in relation to valid chargeback reviews.

If a transaction is disputed, NOCTRA may provide relevant transaction, fraud-screening, payment, communication and delivery records to the payment processor, acquiring bank, card network, card issuer or other relevant party.

NOCTRA reserves the right to challenge disputed transactions and provide evidence showing payment authorisation, customer authentication, Terms acceptance, product details, delivery details, delivery confirmation, supplier confirmation, API records, platform records, IP address, device data and customer communications.

Fraudulent, abusive or repeated chargeback activity may result in order cancellation, refusal of future orders, account restriction, access restriction and recovery of associated costs where permitted by law.

4. Customer Support and Complaints

4.1. NOCTRA provides customer support relating to use of the reseller platform, purchases, delivery issues and refund requests.

4.2. Customer support is accessible by email at contact@noctra.gg.

4.3. Customer support is generally available between 10:00 and 14:00 CEST on business days. Support is available in English.

4.4. When contacting customer support, you should provide your order ID, email address used for the order, product purchased and a clear description of the issue.

4.5. NOCTRA may ask for additional information to verify the order, investigate the issue, confirm delivery details, prevent fraud or resolve the complaint.

4.6. NOCTRA is responsible for assisting users regarding use of the reseller platform and delivery of purchases made through the reseller platform. NOCTRA is not responsible for customer support relating to Steam accounts, game accounts, platform bans, trade restrictions, publisher decisions, game functionality or third-party platform access.

5. Your Personal Data

5.1. NOCTRA collects and processes personal data about you for the purpose of providing the reseller platform, processing purchases, arranging delivery, providing customer support, preventing fraud, managing disputes and complying with legal obligations.

5.2. NOCTRA is the data controller for personal data processed in connection with the reseller platform and purchases made through the reseller platform.

5.3. Personal data may include your email address, account details, order details, delivery details, Steam Trade URL or platform identifier, IP address, device information, browser metadata, payment confirmation data, fraud-prevention signals and customer support communications.

5.4. NOCTRA may share relevant personal data with trusted suppliers, payment processors, acquiring banks, card issuers, card networks, fraud-prevention providers, hosting providers, IT providers, professional advisers and competent authorities where necessary for payment processing, delivery, fraud prevention, security monitoring, chargeback handling, legal compliance or customer support.

5.5. NOCTRA values customer privacy and processes personal data in accordance with the GDPR and applicable data protection laws. Please see NOCTRA’s Privacy Policy for further details on how personal data is collected, used, stored, shared and protected.

6. Fees and Charges

6.1. Access to the reseller platform may be provided free of charge, but you are responsible for the price of any Digital Item purchased through the reseller platform.

6.2. The price of the Digital Item, applicable taxes, service charges and any other charges are disclosed before you complete your purchase.

6.3. Prices may change from time to time. You are only responsible for paying the price disclosed at checkout when you complete your purchase.

6.4. Purchases are payable using the credit card, debit card or other payment method displayed at checkout.

6.5. Transactions may be subject to payment authentication, 3D Secure, payer authentication, AVS, CVV checks, automated fraud screening, manual review, risk scoring or other security checks.

6.6. NOCTRA may decline, delay, cancel or refund an order where payment authorisation fails, fraud screening is not passed, payment verification cannot be completed, the Digital Item becomes unavailable, or the transaction presents legal, security, payment or chargeback risk.

6.7. The name appearing on your card or bank statement may differ depending on the payment processor, acquiring bank or card issuer involved in the transaction.

6.8. NOCTRA does not provide deposits, withdrawals, customer balances, stored value, card cash-out, money transmission or currency exchange services.

7. Delivery Details and Platform Account Security

7.1. Unauthorised use

If you become aware of or suspect unauthorised use of your NOCTRA account, email account, Steam account, supported platform account, payment method or delivery details, you must contact customer support as soon as possible.

Once a Digital Item has been delivered to the delivery details provided by you, NOCTRA may not be able to reverse or recover the item.

7.2. Your responsibility

You are responsible for ensuring that:

  • your email account, NOCTRA account, Steam account, supported platform account and related credentials are kept safe and secure;
  • your Steam Trade URL, platform account identifier and other delivery details are accurate, active and controlled by you;
  • your account settings allow receipt of the Digital Item;
  • you do not provide delivery details belonging to another person;
  • you do not share account credentials, trade URLs or security details with unauthorised persons;
  • you notify customer support without undue delay if your account or delivery details are compromised;
  • you comply with the terms, rules and restrictions of any supported platform relevant to the Digital Item.

7.3. If incorrect delivery details are provided by you and delivery is completed accordingly, NOCTRA is not obliged to reissue, replace or refund the Digital Item unless required by law.

7.4. If delivery details are invalid, incomplete, expired, restricted, private, blocked or otherwise unable to receive delivery, NOCTRA may pause fulfilment and request corrected details.

7.5. If delivery cannot be completed after reasonable attempts due to invalid or incomplete delivery details, NOCTRA may cancel the order and issue a refund.

8. Changing the Agreement and Access to the Reseller Platform

8.1. NOCTRA may change these Terms and Conditions or the Privacy Policy from time to time, for example to introduce new products, change delivery methods, reflect supplier requirements, update payment processes, improve security or comply with applicable law.

8.2. The latest version of the Terms and Conditions will be available on the reseller platform.

8.3. The Terms and Conditions applicable to a purchase are the Terms and Conditions in effect at the time the purchase is completed.

8.4. NOCTRA may suspend, restrict or terminate access to the reseller platform, refuse orders, cancel orders or restrict future purchases with immediate effect if NOCTRA reasonably believes that:

  • you have breached these Terms and Conditions;
  • you have provided false, inaccurate or misleading information;
  • your payment method is unauthorised, disputed, high-risk or linked to suspicious activity;
  • your activity creates legal, financial, security, chargeback, operational or reputational risk;
  • you have engaged in fraud, misuse, abusive disputes or unlawful activity;
  • NOCTRA is required or requested to do so by a payment processor, acquiring bank, card issuer, card network, supplier, supported platform, law, regulation or competent authority.

8.5. If an order is cancelled before delivery and you have been charged, NOCTRA will refund the affected amount unless legally prevented from doing so.

9. Promotions

9.1. NOCTRA may offer promotions on the reseller platform from time to time. Such promotions are offered at the complete discretion of NOCTRA.

9.2. Promotions may be subject to additional terms and conditions disclosed with the relevant promotional campaign.

9.3. Promotions may be withdrawn, changed or limited by NOCTRA at any time unless otherwise stated.

9.4. Promotions are not exchangeable for cash and may not be transferred, resold or combined with other offers unless expressly permitted.

10. Limitation of Liability

10.1. The reseller platform is provided “as is” and NOCTRA cannot guarantee that the reseller platform will be free from faults, interruptions, errors, outages or security incidents.

10.2. NOCTRA shall not be liable for damages, losses or costs caused by Steam, Valve, game publishers, game developers, supported platforms, suppliers, marketplaces, payment providers, card issuers, internet providers or other third parties outside NOCTRA’s reasonable control.

10.3. NOCTRA shall not be liable for losses arising from:

  • price changes, market value changes or reduced perceived value of Digital Items;
  • incorrect, expired, inaccessible or unauthorised delivery details provided by you;
  • loss of access to your email account, Steam account, supported platform account or inventory;
  • account bans, trade restrictions, inventory restrictions, platform rules or publisher decisions;
  • supplier downtime, API failure, supported platform outage or inventory-system disruption;
  • unauthorised access to your account, device, email or platform account;
  • phishing, malware, viruses, social engineering or third-party fraud;
  • delays, interruptions, faults or inaccuracies relating to the reseller platform;
  • your breach of these Terms and Conditions or third-party platform rules;
  • your use or attempted use of Digital Items for commercial resale, gambling, wagering, speculative activity or unlawful purposes.

10.4. To the maximum extent permitted by law, NOCTRA shall not be responsible for indirect, punitive or consequential damages or losses, including loss of profit, loss of data, loss of opportunity, loss of goodwill, loss of reputation, loss of account access or loss of expected value.

10.5. Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, or statutory consumer rights that cannot be excluded.

10.6. Subject to section 10.5, NOCTRA’s total liability in connection with an affected order is limited to the amount paid by you for that affected order.

11. Additional Legal Terms

11.1. Changes to the reseller platform

NOCTRA may make changes, updates and upgrades to the reseller platform from time to time. This may include changes to product availability, supported platforms, suppliers, checkout processes, fraud controls, account functionality or delivery methods.

11.2. Intellectual property rights

Upon entering into the agreement, NOCTRA grants you a limited, non-exclusive, non-sublicensable, non-transferable and revocable right to use the reseller platform for personal and lawful purposes.

All intellectual property in the reseller platform, including the NOCTRA brand, logo, design, website content, software, source code, databases, know-how and platform data, is owned by NOCTRA or NOCTRA’s licensors.

You must not copy, reproduce, modify, scrape, reverse engineer, disassemble, misuse or interfere with the reseller platform or any NOCTRA intellectual property.

All game names, item names, skin names, images, artwork, logos, trademarks, publisher names, developer names and platform names belong to their respective owners. Display of such names, images, logos or item data is for product identification and informational purposes only and does not imply endorsement, sponsorship, partnership or official affiliation.

11.3. Force majeure

NOCTRA shall not be liable for any breach or delay in performance caused directly or indirectly by fire, flood, earthquake, natural disaster, war, cyberwar, civil or military disturbance, terrorism, sabotage, strike, riot, epidemic, pandemic, internet outage, supplier outage, supported platform outage, payment network disruption, regulatory action, government action, API failure or any other cause beyond NOCTRA’s reasonable control.

11.4. Severability

If any provision of the agreement is deemed invalid, unlawful or unenforceable, the remaining provisions shall continue to be valid and binding.

11.5. Assignment

You may not assign your rights or obligations under the agreement to any third party. NOCTRA may assign its rights or obligations to an affiliated company, successor, purchaser of the business or other third party where permitted by law.

11.6. No waiver

NOCTRA’s delay or failure to exercise any right or remedy under the agreement does not constitute a waiver of that right or remedy.

11.7. Irish law

The agreement shall be governed by the laws of Ireland without regard to conflict of law principles.

11.8. Dispute resolution

If you are dissatisfied with the reseller platform, a purchase or customer support, please contact NOCTRA at contact@noctra.gg.

If you wish to know more about your consumer rights in Ireland or submit a formal consumer complaint, you may consult the Competition and Consumer Protection Commission in Ireland.

If legal action is brought against you by NOCTRA, the courts of Ireland shall have jurisdiction to settle the dispute. NOCTRA may also bring legal action against you in another country if you are resident in or hold assets in that country, where permitted by law.

11.9. Irish Consumer Rights Act

In accordance with applicable Irish consumer law, you may have a right to withdraw from certain distance contracts.

However, Digital Items purchased through the reseller platform constitute digital content supplied electronically. By completing a purchase, you request and consent to immediate supply of the Digital Item before the end of any applicable cancellation period.

At checkout, you may be required to acknowledge that once supply of the Digital Item begins, you lose your statutory right to cancel the purchase, except where a refund or remedy is required by law.

Accordingly, purchases made through the reseller platform are final once supply of the Digital Item has begun or the Digital Item has been delivered, except where a refund or remedy is required by law or expressly provided in these Terms and Conditions.

12. Prohibited Conduct

You must not use the reseller platform to:

  • engage in fraud, unauthorised payment activity, identity misuse or stolen-card activity;
  • provide false, misleading, incomplete, inaccurate or third-party delivery details;
  • use bots, scripts, scraping tools or unauthorised automation;
  • bypass payment checks, fraud controls, geographic restrictions, platform restrictions or transaction limits;
  • hide your location or identity to circumvent restrictions;
  • conduct commercial resale, marketplace activity, user-to-user trading, cash-out activity or unauthorised business use;
  • use the reseller platform or any Digital Item for unlawful, abusive, deceptive, speculative, chance-based or regulated activity;
  • infringe intellectual property rights or misuse trademarks, logos, artwork, product images, game assets or platform data;
  • interfere with the reseller platform, payment systems, suppliers, APIs, supported platforms or security systems;
  • breach applicable law, card scheme rules, supplier requirements or supported platform rules.
